To use Overturned, you must:

- Be a resident of the United States or using the service on behalf of a US-based individual

- Provide accurate and truthful information when using our platform
Overturned provides the following services:
- Appeal Letter Generation: AI-assisted drafting of insurance appeal letters based on information you provide and publicly available insurer policy documents
- Document Preparation: Formatting and preparation of appeal-related documents for your review and submission
- Informational Resources: General information about insurance appeal rights and processes
All documents generated by Overturned are drafts for your review before submission. You are responsible for reviewing all documents for accuracy before submitting them to your insurer.
Overturned makes no guarantee, warranty, or representation that any appeal letter we prepare will result in approval of your insurance claim. Statistical information we reference reflects aggregate national data and does not predict or guarantee outcomes in any individual case.
Appeal outcomes depend on many factors outside our control, including insurer policies, applicable law, the specific facts of your claim, and the insurer's internal review process. Past results for other customers do not guarantee similar results for you.
Billing: Overturned offers subscription-based access to our services. By subscribing, you authorize us to charge your payment method on a recurring basis at the frequency and rate specified at checkout.
Cancellation: You may cancel your subscription at any time through your account dashboard or by contacting support@overturned.ca. Cancellation takes effect at the end of your current billing period. We do not offer prorated refunds for partial billing periods.
Refunds: All subscription fees are non-refundable except where required by applicable law. If you believe you were charged in error, contact us within 14 days of the charge.
Price Changes: We reserve the right to change our pricing with 30 days' written notice to your registered email address.
By using Overturned, you agree to:
- Provide accurate, complete, and truthful information about your insurance situation and claim details
- Review all documents generated by Overturned before submitting them to your insurer
- Not use our service to submit fraudulent, misleading, or bad-faith insurance appeals
- Comply with all applicable laws and your insurer's appeal procedures
- Not resell, sublicense, or redistribute our services without written permission
You are solely responsible for the accuracy of information you provide and for the final content of any documents you submit to your insurer.
To the maximum extent permitted by applicable law, Overturned and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to loss of insurance coverage, financial losses resulting from appeal outcomes, or missed appeal deadlines due to inaccurate information you provided.
Our total cumulative liability to you for any claims arising from your use of Overturned shall not exceed the total amount you paid us in the three (3) months preceding the claim.
These Terms are governed by the laws of the State of Delaware. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration against Overturned.

All documents generated by Overturned are drafts prepared for your review. You are responsible for:
- Reviewing all generated documents for accuracy before submitting to your insurer
- Ensuring that all factual information in the document is correct and complete
- Verifying that appeal deadlines have not passed before submitting
- Obtaining any required supporting documentation (medical records, physician letters, etc.) separately
- Following your insurer's specific submission requirements and procedures
Overturned is not responsible for errors resulting from inaccurate or incomplete information you provide during the intake process.
Account Information: Name, email address, and payment information when you create an account or subscribe.
Denial & Insurance Information: Information you provide about your insurance denial, including insurer name, denial reason, claim details, and any documents you upload.
Health Information: To generate an effective appeal letter, you may provide health-related information including your medical condition, treatment history, and physician details. This information is used solely to prepare your appeal documents and is never sold or shared with third parties for marketing purposes.
Usage Data: Standard technical information including IP address, browser type, and pages visited. Used to improve our service and for security purposes.
